Article 1: General provisions

The e-commerce website www.kindertapijten.be of Mats & Joy, a one-man business with its registered office at Poeldries 10 in 8552 Zwevegem, VAT BE 1008.957.277 (hereinafter "Mats & Joy") offers its private customers the possibility to purchase the products from its web shop online.

These General Terms and Conditions ("Conditions") apply to every order placed by a visitor to this e-commerce website ("Customer"). When placing an order via Mats & Joy webshop, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions to the exclusion of all other conditions. Additional conditions of the Client are excluded, except when previously, in writing and explicitly accepted by Mats & Joy .

Article 2: Price

All prices stated are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Client.

If delivery, reservation or administrative costs are charged, this will be stated separately.

The stated price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.

Article 3: Offers

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind Mats & Joy . Mats & Joy is only bound by an obligation of means with respect to the correctness and completeness of the information offered. Mats & Joy will under no circumstances be liable in case of manifest material errors, typesetting or printing errors.

If the Customer has specific questions, e.g. about sizes, colour, availability, delivery period or delivery method, we request the Customer to contact our customer service department in advance.

The offer is always valid while stocks last and can be modified or withdrawn by Mats & Joy at any time. Mats & Joy cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this will be explicitly mentioned in the offer.

Article 4: Online purchases

The client has the possibility of purchasing the articles from the Mats & Joy range online.

The purchase is concluded when the client receives the confirmation e-mail from Mats & Joy .

The items will be sent to the Client on the date indicated in the confirmation email.

The Client has the choice between the following payment methods :

by bank card (Bancontact-Mister Cash)

by bank transfer

Mats & Joy has the right to refuse an order due to a serious fault on the part of the Client with regard to orders involving the Client.

Article 5: Delivery and fulfilment of the contract

Articles ordered via this web shop will be delivered within the European Union.

Unless otherwise agreed or expressly specified, the goods will be delivered to the Customer's place of residence within 30 days of receipt of the order.

Any visible damage and/or qualitative defect of an article or any other shortcoming in the delivery must be reported by the Customer to Mats & Joy without delay.

The risk due to loss or damage shall pass to the Customer from the moment he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Client upon delivery to the carrier, if the carrier has been instructed by the Client to transport the goods and this choice was not offered by Mats & Joy .

Article 6: Retention of title

The delivered goods remain the exclusive property of Mats & Joy until paid for in full by the Client.

The Client undertakes, if necessary, to inform third parties of Mats & Joy's retention of title, e.g. anyone who might seize items which have not yet been paid for in full.

Article 7: Right of withdrawal

The provisions of this article only apply to Clients who purchase items online from Mats & Joy in their capacity as consumers.

The Customer has the right to withdraw from the contract within a period of 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day on which the Client or a third party designated by the Client, other than the carrier, takes physical possession of the goods

To exercise the right of withdrawal, the Client must inform Mats & Joy, Poeldries 10 at 8552 Zwevegem, Belgium - info@matsjoy.com - +32 475 745486 of its decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post or e-mail). The Customer may use the attached model withdrawal form (annex below) for this purpose, but is not obliged to do so.

To meet the withdrawal deadline, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The Client must return or hand over the goods, without delay, but in any event no later than 14 calendar days from the day on which he communicates his decision to withdraw to Mats & Joy, to

The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

From the Benelux countries, Germany and France, you can return free of charge with our Bpost return labels. If you are not satisfied, we will refund your money. Every item ordered can be returned or exchanged for another item within 14 calendar days.

The Customer is requested to return the items in their original condition and packaging, with all accessories and instructions supplied with them. If the returned item has diminished in value in any way, Mats & Joy reserves the right to hold the Customer liable and claim compensation for any diminished value of the goods resulting from the Customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

All returned items will be carefully examined. The principle here is that the consumer may only inspect the item as he would be allowed to do in a shop. Returned articles may be tried on, but must not have been used. If an article has suffered a reduction in value due to the Customer's use, this will be charged to the Customer.

If the Customer withdraws from the contract, Mats & Joy shall refund to the Customer all payments received from the Customer up to that moment, including standard delivery costs, within a maximum of 14 calendar days after Mats & Joy has been informed of the Customer's decision to withdraw from the contract. In the case of sales contracts, Mats & Joy may wait until it has received all the goods back or until the Customer has proved that he has returned the goods, whichever comes first.

Any additional costs resulting from the Customer's choice of a mode of delivery other than the least expensive standard delivery offered by Mats & Joy shall not be refunded.

Mats & Joy shall reimburse the Customer using the same means of payment as the Customer used to make the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer shall not be charged for such reimbursement.

The Customer cannot exercise the right of withdrawal for:

the delivery of goods manufactured according to the Customer's specifications, or which are clearly intended for a specific person;

Article 8: Guarantee

Pursuant to the Act of 21 September 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact Mats & Joy customer service and return the item to Mats & Joy at the Customer's expense.

If a defect is detected, the Client must inform Mats & Joy as soon as possible. In any case, any defect must be reported by the Client within 7 days of its detection. Thereafter any right to repair or replacement shall lapse.

The (commercial and/or legal) warranty shall never apply to defects that arise as a result of accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, non-compliance with the user instructions or manual, adjustments or modifications to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Article 10: Penalties for non-payment

Without prejudice to the exercise of other rights available to Mats & Joy, in the event of non-payment or late payment, the Client shall be liable, ipso jure and without formal notice, to pay interest of 10% per annum on the unpaid amount from the date of default. In addition, the Client shall be liable, ipso jure and without notice, to pay a fixed indemnity of 10% on the amount concerned, with a minimum of €25 per invoice.

Without prejudice to the foregoing, Mats & Joy reserves the right to take back items that have not been paid for (in full).

Article 11: Privacy

The controller, Mats & Joy, respects the General Data Protection Regulation and the Belgian Privacy Act of 30 July 2018.

The Client accepts that electronic communications and backups may serve as evidence.

Article 16: Applicable law - Disputes

Belgian law shall apply, with the exception of the provisions of international private law on applicable law.

Only the courts of Kortrijk have jurisdiction in the event of legal disputes.

The Consumer can also turn to the ODR platform (https://ec.europa.eu/consumers/odr/).
